Scope of Application
The General Terms and Conditions for the webshop apply to all legal transactions of Peter Watches and Optics AG in connection with the web-store Peterstones.ch.
By agreeing to these terms, they are considered accepted. Any general purchasing conditions or divergent conditions of the customer are explicitly excluded.
This web-store is exclusively intended for customers with a residence or business address in Switzerland. All orders must be placed by individuals who have reached the minimum age of 18 years.
Information about Products, Prices and Costs, Availability, and Delivery Times
Images of products and product information on this website are for illustration purposes only and are not binding. The same applies to information about individual products, as they serve for informational purposes. The information provided by the manufacturer (e.g., regarding manufacturer warranty) is exclusively applicable in Switzerland. The prices indicated on the website include the applicable statutory value-added tax.
All information regarding availability and delivery times is without guarantee.
Conclusion of Contract
Peterstones.ch confirms receipt of the order via automated email within 24 hours in principle. However, please note that this email does not yet constitute a contract conclusion. A contract is only concluded with the subsequent email dispatch confirmation.
Changes and Cancellations of Orders
Peterstones.ch accepts subsequent changes or cancellations of customer orders until the dispatch confirmation has been sent.
Returns/Right of Withdrawal
For products that have been created as individual customer orders, there is no general right of return. For other products, the customer can return the product within fourteen (14) calendar days after receipt under the following conditions:
– The product is in its original condition, i.e., seals, original strings, labels, and protective films are intact and undamaged.
– The product and all accessories are present in the original packaging.
– The modalities according to the separately posted cancellation policy on the homepage are observed.
Delivery Date and Acceptance Default
The delivery date is communicated by email or the customer is personally contacted in another suitable manner to arrange an individual delivery date. All indicated delivery dates are approximate. If, after a deadline set to them, the customer refuses to accept the products or declares not to want to accept them, Peterstones.ch can refuse to fulfill the contract.
Delivery
In the case of delivery to the address provided by the customer, visible quantity differences must be immediately reported in writing upon receipt of the goods (to the carrier and to Peterstones.ch). Complaints regarding damaged or defective packaging as well as partially missing shipments must also be reported immediately upon receipt of the delivery.
Reservations in Stores
An e-reservation does not constitute a contract conclusion.
Payment and Offsetting
The exclusive method of payment is by credit card (Visa, Mastercard) and postcard and post e-card. Payment is to be made in advance. The charge will be made upon ordering. Delivery will take place only after payment of the total amount of the ordered products is received.
Retention of Title
The product remains the property of Peterstones.ch until full payment. Furthermore, the customer is obliged to fulfill the further requirements and formalities for the validity of the retention of title.
Transfer of Benefit and Risk
The risk passes to the buyer as soon as the shipment is handed over to the person carrying out the transport. If the shipment is delayed or becomes impossible without Peterstones being at fault, the risk passes to the buyer with the notification of readiness for dispatch. An individually agreed assumption of transport costs by Peterstones has no effect on the transfer of risk.
Complaints and Delivery of Defective Products
The customer must inspect the product for visible defects upon delivery. If the customer discovers an open defect after delivery or a hidden defect later on, they must inform Peterstones.ch in writing about the defect within five (5) days of discovery.
The defective product can be returned with the attached copy of the invoice, properly packaged for postage, and with the correct return address directly to Peter Watches and Optics AG. Otherwise, the product must be sent to Peter Watches and Optics AG by post at the customer’s expense and risk. In both cases, the original packaging must be included. The acceptance of the product does not imply recognition of the defect. The examination of the claimed defect will be carried out by Peter Watches and Optics AG.
Consequences of Defective Products
Peterstones.ch offers the customer the same guarantees that it receives from manufacturers or suppliers.
Exclusion of Warranty
The warranty rights are void if the customer or a third party makes changes to the products, exchanges parts, or uses consumables that do not correspond to the original specifications without the prior consent of Peterstones.ch. The same applies to defects that result from improper use, storage, and handling of the products, external interventions, as well as the opening of products. Insignificant deviations from the product information do not trigger warranty rights.
A warranty for normal wear and tear, consumables, accessories, and supplied batteries/accumulators is excluded. Warranty claims of
the customer may not be assigned to a third party without the prior written consent of Peterstones.ch.
Liability and Liability Disclaimer
Peterstones.ch is liable – regardless of the legal basis on which the claim is based – in no case for slight negligence, indirect and consequential damages, and lost profits, unrealized savings, as well as damages arising from delivery delays, as well as any actions and omissions of the assistants of Peterstones.ch, whether contractual or non-contractual. Furthermore, Peterstones.ch is not liable for damages caused by the following reasons. Improper, contractually non-compliant, or illegal storage, adjustment, or use of the products, use of incompatible replacement or accessory parts, omitted maintenance and/or improper modification or repair of the products by the customer or a third party, force majeure, in particular elemental, moisture, fall, and impact damages.
Applicable Law and Jurisdiction
All legal relationships between Peterstones.ch and the customer are subject to substantive Swiss law, with the exclusion of the provisions of international private law. The ordinary courts in Switzerland are exclusively competent for disputes arising from the legal relationships between the customer and Peter Watches and Optics AG. Peter Watches and Optics AG is entitled to take legal action against the customer at the competent court of their place of residence or any other competent court.
